1. You, as a user and customer alike, by using and visiting MovieJungle.net or MovieJungle.com (which includes all the functionality as well as content found on any of the above Movie Jungle domains, signify your agreement to (A) these terms and conditions (the "Terms of Service") listed in this sections as well as (B) Movie Jungle’s Privacy Policy which may be found at http://www.moviejungle.net/privacy

2. We may contact you considering any revision made to these terms of service at any time. That said, these terms may be altered and added to at the discretion of Movie Jungle International, INC. (or “MovieJungle.net” or “MovieJungle.com”) at any time. It is your responsibility to make sure you periodically review the most up-to-date version at http://www.moviejungle.net/terms. You agree to be bound by such modifications or revisions. Nothing in this Agreement shall be deemed to grant or give any third-party rights or benefits as such.

2. MovieJungle.com/.net Website
1. These Terms of Service apply to all users of the MovieJungle.com and MovieJungle.net Website, as well as those users who are uploading any video content, images, information, and/or any other materials including comments, reviews, forum posts and polls and more on the MovieJungle.net or MovieJungle.com websites.

2. The Movie Jungle website may contain links to third-party websites that are not owned or controlled by Movie Jungle. As such, Movie Jungle has no control over nor do any of its websites (Moviejungle.com, MovieJungle.net, MovieJungle.biz) claim any responsibility for the content and or privacy policies and practices as such of third-party websites. Movie Jungle cannot and will not edit or sensor any content from third party website. As such, by using MovieJungle.com, MovieJungle.net and MovieJungle.biz, you relieve Movie Jungle of any and all liability which may arise from any third-party websites and the usage of any third-party website.

3. As a precaution, we encourage all users who may leave Movie Jungle to visit any external sites whether third-party or not, to exercise caution and not download any content you are not fully aware of. Please read any applicable terms and conditions as well as any privacy notices you find on sites visited by yourself and those who share your computer.

3. Movie Jungle Accounts
1. To access numerous features, you may create a Movie Jungle account. To access this account, you will need to provide login credentials. You may never try make use of or access another registered users account. As such, you are solely responsible for any activity which occurs on your account and you must keep your account password secure to avoid access by unwanted parties. You must notify Movie Jungle immediately if you suspect there has been any breach of security someone has achieved unauthorized use of your account.

2. Movie Jungle will not be liable for any of your losses whether of private information, financial and other which is caused by any unauthorized use of your account. Additionally, you may be liable for the losses of Movie Jungle or others due to such unauthorized use.

4. General Use of the Website—Permissions and Restrictions

Movie Jungle grants you permission to access and use the Website as set forth in these Terms of Service, provided that:
1. You agree not to distribute in any medium or any part of the Website strictly without prior written permission from Movie Jungle.

2. You agree not to modify and/or alter any part of the Website which includes but is not limited to Movie Jungle's Embeddable Player or any of its related original content or technologies.

3. You agree not to access any user content (described below) or any content found on any of the Movie Jungle domains (MovieJungle.com, MovieJungle.biz, MovieJungle.net) through any technology or means other than the video playback pages of the Website itself, the Movie Jungle player, or other authorized means Movie Jungle may have made explicitly available.

A. You agree not to use any part whatsoever of the website be it the embeddable Movie Jungle player, forums, user comments, user account profiles or other for any commercial use without the prior written permission of Movie Jungle with an official company letterhead.

Forbidden commercial uses include any of the following:

Use of the MovieJungle.com, MovieJungle.net and MovieJungle.biz domains for generating and/or gaining revenue via advertising or subscription. Any advertising without prior written permission from Movie Jungle may result in account banning without prior written, email or verbal warning.

The sale of advertising, on the MovieJungle.com, MovieJungle.net or MovieJungle.biz websites or any third-party website, targeted to the content of specific user additions or submissions or other content on Movie Jungle.

The sale of access to Movie Jungle and its related services be it the Movie Jungle player, user account profiles, user galleries and any other Movie Jungle service.

The usage of any content submitted by other registered users be it of whatever nature, for your own monetary gains.

Commercial uses which are not forbidden are:

The uploading an original video to Movie Jungle or having your own, original Movie Jungle Channel to promote your own Film or TV business. That said, pornographic channels or materials are strictly forbidden and will be removed with further legal action a possibility.

The use of the Movie Jungle video player to show Movie Jungle videos on a website with advertising on the site with the exception that the Movie Jungle role is not to gain advertising act as a competitor to Movie Jungle.

Any use that Movie Jungle has authorized in writing accompanied with a letterhead and signature of an official.

If one chooses to use the Movie Jungle player on their site, they must link back to the appropriate page on either the MovieJungle.com, MovieJungle.net or MovieJungle.biz domains. Additionally, the modifying in any part whatsoever of the Movie Jungle player in any way, is strictly forbidden.

In using the player, video upload, gallery, forum and user comments pages, you agree that automatically downloaded updates may be available, especially from the player itself. Such updates may serve to enhance the player, fix any bugs and more. You agree to receive such updates.

You agree to not use any automated system/s which can and may including "robots," "spiders," or "offline readers” which can access any of the Movie Jungle. Movie Jungle grants the operators of public search engines the permission to use spiders with the purpose of copying materials from the site for the sole purpose of creating public searchable indices of the Movie Jungle materials. Not, however caches or archives of said materials, which is forbidden. Movie Jungle may revoke such rights as they deem fit either towards one specific case or entirely.

You agree not to collect any personally identifiable information which may include account names, from any Movie Jungle domain.

You agree to not to use either the email, user comments or forums within Movie Jungle for any commercial solicitation purposes which includes solicitation to other users of the websites.

Movie Jungle reserves the right to discontinue any and all parts of any of the MovieJungle.com, MovieJungle.net, MovieJungle.biz domains as it deems fit without any prior notice whatsoever and need for explanations thereof.

5. Your Use of Content on Movie Jungle

Further conditions apply specifically to your use of all the content found on the Movie Jungle website:
1. You understand that when using any of the Movie Jungle Websites, you will be exposed to User Additions in the form of video, comments, galleries and other formats and that Movie Jungle is not responsible for the accuracy of such submitted information nor its accuracy, safety, legitimate resourcefulness or intellectual property rights. You further understand and agree that you may be exposed at some point to content which you may find offensive, objectionable, inaccurate or indecent and agree as such to waive any legal or equitable rights and/or remedies you may have against Movie Jungle and any of its owned domain names including its financial officers, owners, agents, employees, affiliates, licensors and licensees and hold Movie Jungle and all its personnel harmless to the fullest extent allowed by law regarding all matters which are related to any of its websites.

2. User Additions are for your information and personal use ONLY through the functionality intended through the Movie Jungle websites. That said, you cannot and may not copy or download any User Additions except if perhaps a link to download such content has been provided by Movie Jungle and is allowed by licensors or affiliate companies, agents and/or advertisers.

3. Movie Jungle Website content (except all User Additions) including without limitation:

(A) Site created graphics, text, any created software, scripts, photography or logos owned designed or taken by Movie Jungle, sounds, music, videos and related content, interactive features, trademarks, which are either owned or licensed to Movie Jungle and are subject to copyright and other intellectual property rights under protection of the law.

5. You agree that content cannot be copied, broadcast, sold, licensed, downloaded, reproduced, transmitted used for the purpose of distribution, displayed, or exploited in any manner or form whatsoever for any commercial purposes.

6. You sincerely agree to never meddle with any security-related features of any of the Movie Jungle Websites or the features that stop any copying of any site content or any imposed confines of use of any of the Movie Jungle websites and their content providers and affiliated companies as such.

6. Your User Comments, Video, Image and other additions/submissions as well as Codes of Conduct
1. As a registered user of Movie Jungle and an account holder as such, you may submit/upload videos, graphics, images and photography for galleries as well as textual content for user comments, news comments, forums and reviews. The addition of the abovementioned items will be referred to as "User Additions." If said content is published, Movie Jungle does not and will not guarantee any confidentiality as such.

2. You alone are responsible for your User Additions and accordingly, all the consequences of posting or adding any content on the site. In connection with Additions, you confirm and agree to the following:

(A) You are the owner or have legally licensed, achieved consent, being granted permission or assigned the required legal rights to publish the content you are adding whether video, textual or image-wise. As such, you authorize Movie Jungle and its website to use all copyright(c), patent, trademark™, trade secret, or any other proprietary rights in and to any and all User Additions to enable inclusion on the Movie Jungle website/s and use of the User Additions in the manner considered by Movie Jungle and the Terms of Service herein.

3. You still retain all of the ownership rights to the material in your User Additions but, by adding them to Movie Jungle you grant MovieJungle.com, MovieJungle.net, MovieJungle.biz and any other Movie Jungle owned websites, a worldwide and non-exclusive as well as sublicenseable , royalty free, as well as transferable license to use, distribute, reproduce and prepare derivative works of for display within the site/s in any media formats and through any media channels. As such, you grant each user on MovieJungle.com, MovieJungle.net, MovieJungle.biz and other Movie Jungle owned sites, a non-exclusive license to access any and all of your publicly available User Additions through the website/s under the listed terms and conditions herein. You agree and fully understand that Movie Jungle may retain, but not display, any deleted or removed User Additions.

(A) You may not upload or add in any way whether in video, text or image, any copyrighted(c) material, trade secret or material otherwise subject to third party proprietary rights unless you are the owner of the material or have explicit permission from the rightful owner to post their material and to grant Movie Jungle all license rights herein.

(B) Movie Jungle does not endorse any User Additions, opinions, advice or recommendations made and expressly disclaims any and all liability in connection with User Additions. In other words we are not liable for any copyrighted(c) material added to our site by User Additions. If such material is added and you are the owner or acting licensee or licensor please contact us at reviews@moviejungle.com to review the added material and remove it if it is indeed justified. Movie Jungle reserves the right to remove any and all content which we feel breaks copyrights(c), trademarks or is against Movie Jungle terms, conditions, policies or privacy.

7. Policy towards Account Termination
1. Movie Jungle will immediately terminate any user access to its Website if they have shown to be a repeat offender of forbidden activity. Should you feel unjustly terminated, you may contact reviews@moviejungle.com and appeal this decision.

2. Movie Jungle reserves the right to decide what user content added or submitted to the site whether video, imagery or text, is appropriate and complies with the Terms of Service for violations other than copyright infringement. Inappropriate content which will be removed includes but is not limited to: pornographic materials, obscene or defamatory material, racist comments, video or imagery and/or obscene hand signs. Movie Jungle may remove User Submissions and terminate a User's access for uploading such material which violates the Terms of Service at any time and is not obliged to give any notice whatsoever as such.

8. Warranty Disclaimer

You agree that you use MovieJungle.net, MovieJungle.com, MovieJungle.biz at your own risk. To the fullest extent permitted by law, Movie Jungle International, INC, its owners, employees, agents, officers, directors and anyone employed by Movie Jungle, disclaim any and all warranties or representations about the accuracy or completeness of content within any of its sites (MovieJungle.net, MovieJungle.com, MovieJungle.biz) and your use thereof. Movie Jungle makes no warranties or representations about the content of any of its websites or any sites linked to MovieJungle.net, MovieJungle.com and MovieJungle.biz and assumes no responsibility or liability for:
1. Mistakes, erroneous content.

2. Personal injury or damage whether physical, mental or spiritual or of any other nature resulting from accessing MovieJungle.net, MovieJungle.com and MovieJungle.biz

3. Damage to equipment or property damage of whatever kind resulting from accessing MovieJungle.net, MovieJungle.com and MovieJungle.biz

4. Any unauthorized access to or use thereof of our servers and/or any personal information and/or financial information which may be stored therein.

5. Any interruption or termination to or from any of our websites.

6. Any viruses, Trojan horses, bugs or similar which may be transmitted to or from our website by anyone whatsoever including third parties.

7. Any errors of omissions in content or for any damage or loss of any kind which happened as a result of the use of any content which was posterd, emailed, uploaded or submitted in any form whatsoever be it video, text or image.

8. Advertising prices of third-party vendors or advertisers of products and services on any of its domains.

9. Limitation of Liability

In no event and at no time whatsoever at all shall the officers of Movie Jungle International, INC whether employees, financial officers, owners, directors and agents be liable to your for any and all direct, indirect, special, punitive consequential or incidental damages whatsoever resulting from:
1. Personal injury or property damage resulting from the use of MovieJungle.com, MovieJungle.biz or MovieJungle.net or any of the Movie Jungle owned domain names.

2. Inaccurate content, mistakes and errors.

3. Any unauthorized access to or the use of any of the Movie Jungle servers.

4. Any unauthorized account access, financial information, personal information stored within any Movie Jungle website.

5. Any interruption of service or cessation of transmission to or from our websites.

6. Any bugs, viruses, Trojan horses or the like which may be transmitted to or from our website/s by any third party vendors.

7. Any omissions or lost content which was submitted, posted, emailed or added in any other way which has been made available via any Movie Jungle websites and their affiliated companies or vendors whether based on contract, warranted or any other legal theory, whether the company is advised of the possibility of said damages, the foregoing limitation of liability shall apply to the fullest extent which is permissible by the law in the applicable jurisdiction.

8. Any site instability – At times, this out of the most enhanced websites control.

10. Indemnity

You agree to defend, indemnify and hold harmless MovieJungle.com, MovieJungle.net and MovieJungle.biz, the parent corporation, any of its staff including and not limited to its owners, directors, agents, officers, and all employees from and against any and all damages, claims, liabilities, obligations, losses, costs, and expenses (which may include but not limited to any fees arising from legal action or attorneys fees as such) arising from:
(A) Your use of and access to any of the Movie Jungle Websites.

(B) Any violation on your part of any term of these Terms of Service.

(C) Any violation on your part of any third party right, which may include and is not limited to any copyrighted materials, privacy rights, properties.

(D) Any claim that one of your User Additions is responsible for causing any damage to a third party of any sex, race or creed. This defense and indemnification obligation will survive these Terms of Service and your use of the Movie Jungle Website.

11. Ability to Accept Terms of Service

In accepting these terms and conditions set forth in this document, you verify that you are over 18 years of age, or an emancipated minor, or have the consent of a legal parent or legal guardian and are fully able and competent to enter into all the mentioned terms and conditions, user obligations and warranties set forth in these Terms of Service. You agree to abide by and comply with these Terms of Service always and agree with any consequences should you break agreeing to these terms of service. The Movie Jungle website is for users over the age of 13 and is not intended for usage by younger web surfers/users. You agree that you are over the age of thirteen. If you are not, please stop using the site immediately or ask the permission of your parents. Movie Jungle is not liable both legally and for any repercussions as such for under age users viewing content we have advised against.
